Delhi assembly speaker Ram Niwas Goel terminated the membership of Chhatarpur MLA Kartra Singh Tanwar under the Anti-Defection Law. In July this year, Chattarpur MLA Kartar Singh Tanwar left AAP and joined the BJP. But his assembly membership has been terminated, officials said on Monday.
Who is Kartar Singh Tanwar?
Before entering politics, Kartra Singh Tanwar was a junior engineer on the Delhi Jal Board(DJB). Kartar Singh Tanwar started his career in politics in 2007. Kartar Singh Tanwar, who joined the Aam Admi Party in 2014, left the party and joined the BJP party on 10th July. Kartar Tanwar won the 2020 assembly elections from Chhatarpur in Delhi on an Aam Aadmi Party ticket, but later changed sides and joined the BJP. Along with Tanwar, former Delhi minister Raj Kumar Anand also left AAP. Kartar Singh Tommar came into the limelight when he was raided by the Income Tax Department in July 2016.
what is Anti- Defection Law?
The Anti-Defection Law (ADL) is a constitutional amendment in India that aims to prevent members of the legislature from switching parties or voting against their party's directives. The law was introduced in 1985 as the 52nd Amendment to the Constitution of India.
Grounds for disqualification:
A Member of Parliament (MP) or a Member of the Legislative Assembly (MLA) may be disqualified if they defect from their party after the election.
If an elected representative joins another political party after the election, they are subject to disqualification unless they resign from their original party.
If an elected member votes or abstains from voting in the House, contrary to any direction issued by his political party.
If any nominated member joins any political party after the end of six months.
The decision on disqualification questions on the ground of defection is referred to the Speaker or the Chairman of the House, and his/her decision is final.
